Terms of Use

By downloading, installing, accessing, or using the One mobile application (“App,” “Service,” or “One”), you (“User,” “you,” or “your”) agree to be bound by these Terms of Use (“Terms”). These Terms constitute a legally binding agreement between you and the developer of One (“we,” “us,” “our,” or “Developer”).

If you do not agree to all of these Terms, you must not download, install, access, or use the App. Your continued use of the App following any modifications to these Terms constitutes your acceptance of those modifications.

These Terms apply to all users of the App, including users who browse, access, or use the App without creating an account (anonymous users) and users who authenticate via Apple Sign-In.

One is a personal reflection and journaling application designed for iOS devices. The App provides the following core features:

2.1 Reflection Sessions

Guided journaling sessions where users respond to AI-generated prompts and follow-up questions, designed to help users reflect on their daily experiences, thoughts, and emotions.

2.2 AI-Generated Insights

Using Google's AI services, the App analyses user-submitted reflection content to generate emotional summaries and sentiment assessments, identified emotions and topics, actionable suggestions, monthly timeline insights, and calendar-based rhythm insights.

2.3 Breathing and Meditation Practices

Guided breathing and relaxation exercises, including box breathing sessions, resonant coherence breathing sessions, and AI-generated custom relaxation sessions with visual guidance.

2.4 Focus Sessions

Timed productivity and focus sessions to support concentration.

2.5 Mood Tracking

A mood slider (numerical scale from 0.0 to 1.0) enabling users to record their emotional state during each reflection.

2.6 Data Export

Users may export their reflections in JSON format for personal use.

2.7 Customisation

Users can customise the App's appearance, including app icons, themes (System, Light, Dark), and accent colours.

3.1 Age Requirement

You must be at least 13 years of age to use the App. If you are between the ages of 13 and 18 (or the age of legal majority in your jurisdiction), you may only use the App with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

3.2 Legal Capacity

By using the App, you represent and warrant that you have the legal capacity to enter into these Terms and to comply with all applicable laws and regulations in your jurisdiction.

3.3 Account Responsibility

If you create an account (via Apple Sign-In) or use the App anonymously, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account or device.

4.1 Account Types

Apple Sign-In: Users may authenticate using their Apple ID. The App requests access to your full name and email address. Apple's privacy features, including the option to hide your email address, are respected.

Anonymous Access: Users may access the App without creating an account. Anonymous users receive a unique identifier but do not have a persistent identity tied to personal information.

4.2 Account Security

All authentication is managed through Firebase Authentication. Access to backend services is secured using Firebase ID tokens and Firebase App Check tokens. In production, device verification uses Apple's App Attest framework to ensure requests originate from genuine instances of the App.

4.3 Account Termination

You may sign out of the App at any time, which clears your authentication state on the device. We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice.

5.1 AI Provider

The App uses Google's AI services to power its reflection analysis, question generation, insight creation, and session generation features. AI processing is performed via a backend service hosted on Google Cloud Run (located in the europe-west1 region).

5.2 Data Sent to AI

When you use AI-powered features, the following data is transmitted to the backend and subsequently processed by Google's AI services:

• Your conversation history within the current reflection session
• Mood scores you have recorded
• Summaries of your recent reflections (up to 5 most recent) for contextual analysis
• Emotional topics identified in prior reflections

5.3 AI-Generated Content Disclaimer

All AI-generated content is produced by an automated system and is provided for informational and personal reflection purposes only. AI-generated content:

• Is not a substitute for professional medical, psychological, psychiatric, or therapeutic advice, diagnosis, or treatment
• May not always be accurate, complete, or appropriate for your individual circumstances
• Should not be relied upon as the sole basis for any decision affecting your mental health, well-being, or personal life
• May occasionally produce responses that are irrelevant, repetitive, or inconsistent

5.4 No Professional Relationship

Use of the App does not create a therapist-client, doctor-patient, counsellor-client, or any other professional relationship. The App is a personal journaling and reflection tool and is not a mental health service, crisis intervention tool, or medical device.

5.5 Crisis and Emergency Situations

The App is not designed to handle mental health emergencies or crises. If you are experiencing a mental health crisis, suicidal thoughts, or are in immediate danger, please contact:

• Emergency services (e.g., 911 in the United States)
• The National Suicide Prevention Lifeline: 988 (United States)
• The Crisis Text Line: Text HOME to 741741 (United States)
• Your local emergency services or mental health crisis line

5.6 AI Limitations

You acknowledge and agree that the AI model may produce inaccurate, biased, or misleading outputs; AI-generated sentiment scores are approximations; the AI does not have memory of prior sessions beyond what is explicitly provided in context; and AI responses do not represent the views or opinions of the Developer.

6.1 Ownership

You retain full ownership of all content you create, submit, or input into the App, including reflection text, journal entries, chat messages, and mood data (“User Content”).

6.2 Licence Grant

By using the App, you grant us a limited, non-exclusive, non-transferable licence to process your User Content solely for the purpose of providing the App's services to you. This licence does not grant us the right to sell, share, publish, or distribute your User Content to any third party except as required to operate the AI features described herein.

6.3 User Responsibilities

You agree that you will not use the App to:

• Submit content that is illegal, defamatory, obscene, threatening, harassing, or otherwise objectionable
• Attempt to manipulate, exploit, or abuse the AI system through prompt injection, adversarial inputs, or other techniques
• Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the App
• Interfere with or disrupt the App's servers, networks, or backend infrastructure
• Use the App for any commercial purpose without prior written consent
• Attempt to bypass security measures
• Use automated scripts, bots, or tools to access or interact with the App

6.4 Content Moderation

The App does not include a built-in content moderation system as it is a private journaling tool with no user-to-user content sharing. However, Google's AI services may decline to process certain inputs at the API level in accordance with Google's usage policies.

7.1 Premium Subscription

The App offers optional premium subscription plans: Pro Monthly (recurring monthly) and Pro Yearly (recurring annual).

7.2 Premium Features

Premium features may include (subject to change): biometric lock (Face ID / Touch ID), iCloud sync, app icon customisation, and access to exclusive new features.

7.3 Billing and Payment

All subscriptions are processed through Apple's App Store and are subject to Apple's terms and conditions. Payment will be charged to your Apple ID account at confirmation. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions in your App Store Account Settings.

7.4 Refunds

Refund requests must be directed to Apple in accordance with Apple's refund policies. We do not process refunds directly.

7.5 Free Features

Core reflection, breathing, focus, and mood tracking features are available without a subscription. We reserve the right to modify which features are included in the free tier at any time.

7.6 Price Changes

We reserve the right to change subscription pricing at any time. Changes take effect at the start of the next billing cycle following notice.

8.1 App Ownership

The App, including its design, code, visual elements, user interface, icons, logos, text, and all other components (excluding User Content), is the property of the Developer and is protected by applicable intellectual property laws.

8.2 Trademarks

“One” and associated logos and branding are trademarks of the Developer. You may not use these trademarks without prior written consent.

8.3 Third-Party Intellectual Property

The App uses third-party technologies and services (Google AI Services, Firebase, Apple StoreKit, Apple AuthenticationServices), each subject to their own terms.

8.4 Restrictions

You may not copy, modify, or distribute the App; create derivative works; remove proprietary notices; or use the App's branding without written consent.

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy for detailed information on how we collect, use, store, and protect your data.

10.1 Service Availability

We strive to maintain the App's availability but do not guarantee uninterrupted, error-free, or continuous access. Functionality depends on your device's operating system, internet connectivity, and availability of third-party services.

10.2 Offline Functionality

Certain features may function without an internet connection, including viewing previously saved reflections and cached insights. AI-powered features require an active internet connection.

10.3 Modifications

We reserve the right to modify, update, suspend, or discontinue the App or any of its features at any time, with or without notice.

10.4 Updates

App updates may be released periodically through the Apple App Store. You are responsible for installing updates to ensure optimal performance and security.

11.1 The App is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy.

11.2 We do not warrant that AI-generated content, including emotional assessments, insights, summaries, action items, or sentiment scores, will be accurate, complete, reliable, or suitable for any particular purpose.

11.3 The App is not a medical device, therapeutic tool, or mental health service. We make no representations or warranties regarding the App's suitability for addressing mental health conditions, emotional disorders, or psychological needs.

11.4 We are not responsible for the availability, accuracy, or reliability of third-party services used by the App.

12.1 To the maximum extent permitted by applicable law, in no event shall the Developer, its affiliates, or its licensors be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of data, loss of goodwill, emotional distress arising from AI-generated content, inability to access the App, unauthorised access to your data, or any reliance on AI-generated insights.

12.2 Our total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the App shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim, or fifty US dollars ($50.00), whichever is greater.

12.3 The limitations of liability set forth above shall apply even if any remedy provided herein fails of its essential purpose and regardless of whether we have been advised of the possibility of such damages.

You agree to indemnify, defend, and hold harmless the Developer and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from your use or misuse of the App, your violation of these Terms, your violation of any applicable law, content you submit to the App, or any claim that your User Content caused damage to a third party.

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Developer is located, without regard to its conflict of law provisions.

14.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If a dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through the courts of competent jurisdiction.

14.3 Waiver of Class Action

To the fullest extent permitted by law, you agree that any claims shall be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative action.

15.1 By You

You may terminate your use of the App at any time by deleting it from your device. If you have an active subscription, you must also cancel it through the Apple App Store.

15.2 By Us

We may terminate or suspend your access immediately, without prior notice or liability, for any reason, including if you breach any provision of these Terms.

15.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. Locally stored data remains on your device until the App is deleted. We are not obligated to retain, store, or provide copies of your User Content. Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, Indemnification, and Governing Law) shall survive.

The App may send push notifications to remind you to reflect, using Apple's UserNotifications framework and Firebase Cloud Messaging (FCM). Notifications are optional. You control preferences within the App's settings, including enabling/disabling notifications, setting frequency, and setting preferred notification time. You may revoke permissions at any time through iOS Settings.

The App provides the ability to export your reflections in JSON format, including reflection entries, timestamps, mood scores, and associated metadata. You are solely responsible for the security, storage, and use of any exported data. We are not responsible for any data loss, unauthorised access, or misuse of exported data once it leaves the App.

18.1 Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Developer regarding your use of the App.

18.2 Severability: If any provision is found unenforceable, it shall be limited or eliminated to the minimum extent necessary, and the remaining provisions remain in full force.

18.3 Waiver: Failure to exercise or enforce any right shall not constitute a waiver of such right.

18.4 Assignment: You may not assign these Terms without our prior written consent. We may assign without restriction.

18.5 Force Majeure: We shall not be liable for any failure or delay resulting from causes beyond our reasonable control.

18.6 Headings: Section headings are for convenience only and have no legal or contractual effect.

19.1 App Store Compliance: The App is distributed through the Apple App Store and is subject to Apple's App Store Terms of Service. In the event of conflict, Apple's terms prevail with respect to App Store distribution matters.

19.2 Apple as Third-Party Beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple has the right to enforce these Terms against you.

19.3 Apple's Liability: Apple has no obligation to furnish maintenance or support services. To the maximum extent permitted by applicable law, Apple has no warranty obligation with respect to the App.

19.4 Product Claims: The Developer, not Apple, is responsible for addressing any claims relating to the App, including product liability, regulatory compliance, and consumer protection claims.

19.5 Intellectual Property Claims: The Developer, not Apple, is solely responsible for the investigation, defence, settlement, and discharge of any third-party intellectual property infringement claim.

We reserve the right to modify these Terms at any time. When we make changes, we will update the “Last Updated” date at the top of this document. Material changes may be communicated through the App or other reasonable means. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.
